New York City “Garbage Juice” Slip and Fall Case Shows Hidden Dangers at Apartment Complexes, Rights and Options of New York City Slip and Fall Victims

In November, 2024, an interesting case went to trial in New York City. The case was brought by a New York City resident and slip-and-fall accident victims for a serious injury that he sustained as a result of what he calls “garbage juice” that was left at the housing complex where he was visiting a friend. According to local news reports, Plaintiff R. Branch sued the New York Housing Authority alleging slip and fall injuries for a January, 2019 incident. Branch alleged that he “sustained a serious injury to his hip in January 2019, allegedly by slipping on “garbage juice” seeping from the trash chute “hopper” area onto the hallway of the Bushwick Houses building where he was visiting a friend’s apartment.” Branch further alleged that, “he had gingerly crossed the wet area earlier but fell later when he was instead focused on catching up to and preventing his friend’s young son from entering an elevator alone after the boy had darted out of the apartment corridor.” On the other hand, The New York City Housing Authority contended that “the unfortunate accident could not have happened as Branch portrayed.” Lawyers for the New York City Housing Authority pointed to the fact that an EMT and hospital report noted that Branch said that he was “racing in the hallway with the kids when his right leg gave out.”

Ultimately, although closing statements were made in the case, the parties decided to settle the case outside of court before the jury had the chance to render their decision. The settlement amount was undisclosed.
