From the Medical Malpractice Archives: New York Couple Sues After IVF Mix-Up; Relinquishes Custody of Baby Boys to Biological Parents

In 2019, a New York couple gave birth to two baby boys, but they instantly knew that something had been mixed-up by the doctor that performed their IVF procedure: they were of Korean descent, but the babies were 100% not. The birth of the two babies to a mother who shared no genetic material with them then became a case of national interest, with some describing the unbelievable IVF mix-up as “unprecedented.”

According to national news reports, the New York couple, only known as A.P. and Y.Z. in filings to maintain their privacy, went under an IVF procedure at a Los Angeles clinic, and the doctor at that clinic allegedly inserted embryos from two different mothers who were completely unrelated to each other or the New York woman undergoing the procedure. The result? The New York woman gave birth to two baby boys who were not only not biologically hers or her husbands at all, but also were not related to each other.

The medical malpractice case gained traction in the news in 2019 when a court ordered that the two babies be returned to their biological parents. Afterwards, the New York Couple, A.P. and Y.Z., brought suit against the doctor and the clinic who implanted the New York woman with the mixed-up embryos. Of the horrific medical malpractice error, the mother of one of the boys, Anni Manukyan stated, “[The clinic] robbed me of my ability to carry my own child, my baby boy…To be with him in the first couple moments of his life. To nurse him. To do skin-on-skin contact. To, you know, just be a mom to him.” She also added of the New York woman’s ordeal, “I pray for her every day and God will give her her own beautiful babies one day…Why did you do that to her? What is she going through right now? We are all victims of [the IVF clinic].” A.P. and Y.Z. filed a medical malpractice case against the fertility clinic, CHA Fertility Center, in the United State District Court for the Eastern District of New York for medical malpractice, negligence, battery, and intentional infliction of emotional distress. The Manukyans filed their own separate lawsuit against CHA, alleging similar claims. .

ltimately, it is reported that A.P. and Y.Z. settled their lawsuit against the doctor who performed the IVF procedure and CHA Fertility Center. The nearly-unbelievable case underscores the impacts of doctor medical malpractice in the real world, and how it can impact families. It also serves as an example to New York City medical patients that they have rights and options under New York Laws if they are injured by a doctor or medical professional’s medical malpractice.
